1. Who we are
Atelier 4, LLC, doing business as Atelier 4 (“Atelier 4,” “we,” “us”), is a fine art logistics company. We operate the website at https://www.atelier4.com (the “Site”).
This policy explains what personal information we collect, how we use and share it, how we protect it, and what choices you have. Section 7 is our Anti-Spam Policy, which prohibits the promotion of this Site through unsolicited messages by us or by any third party.
2. Information we collect
Information you give us: your name, job title and organization, email address, postal address, and telephone number; the details you provide to request a quote or have us perform work, including origin and destination addresses, dates, contact persons, and descriptions of the objects to be handled along with their dimensions, condition, and declared or insured value; billing contact and address; and the content of your correspondence with us. If you apply for a job, the résumé and related information you submit.
Our payment processor handles payment card and bank details. Clients opting for automated payment or debiting arrangements will have their payment identifiers and related account data maintained through the secure systems of our merchant and card service affiliates and ERP provider.
Information collected automatically when you visit the Site: IP address, browser and device type, operating system, referring and exit pages, pages viewed and time spent, video play events, on-site search terms and filter selections, and date and time of visit. See §5.
Information from others: clients or counterparties who engage us on your behalf, carriers and customs brokers, and publicly available business sources.
We do not seek sensitive personal information (health, biometric, racial or ethnic, religious, or precise geolocation) through the Site, and ask that you not send it. The Site is directed to businesses and adults, not children; we do not knowingly collect information from anyone under 13, and will delete it promptly if notified at communications@atelier4.com.
3. How we use it
To respond to inquiries and provide quotes; to arrange, perform, and document our services, including transport, crating, installation, storage, customs clearance, project management, and condition reporting; to arrange insurance and handle claims; to invoice you and process payments; to communicate with you about active or prospective work; to send newsletters and marketing where permitted (§6); to operate, secure, and improve the Site; to evaluate job applicants; to prevent fraud and abuse of our systems; and to meet our legal, tax, customs, insurance, and regulatory obligations.
We keep personal information only as long as necessary for these purposes and to satisfy our legal, tax, customs, and insurance obligations, and then delete or anonymize it. Records connected to work we performed are generally retained for the periods those obligations require.
4. How we share it
We do not sell your personal information, and we do not share it for targeted or cross-context behavioral advertising. We disclose it only to:
- Service providers who operate our business on our behalf under contracts requiring them to protect it and use it only as we instruct — our website platform (Squarespace), site analytics and tag management (Google Analytics and Google Tag Manager, alongside our website platform’s built-in analytics), embedded forms (Jotform), email marketing and distribution (Intuit Mailchimp), business email and file storage (Google Workspace), customer relationship and enterprise resource management (Oracle NetSuite), payment processing, and accounting.
- Parties needed to perform the work — carriers, airlines, freight forwarders, customs brokers, government customs and border authorities, insurers and their surveyors, warehouses, installers, and industry-related service providers.
- Professional advisers — lawyers, auditors, accountants, and insurers, where reasonably necessary.
- An acquirer, if we are involved in a merger, acquisition, financing, or sale of assets, subject to this policy.
- Authorities and others, where required or necessary — where compelled by law, subpoena, court order, or other legal process, or where we believe in good faith that disclosure is necessary to comply with law or a lawful law-enforcement request, to protect the security or integrity of the Site, to prevent fraud or abuse, or to protect the rights, property, or safety of Atelier 4, our clients, or others.
5. Cookies and Do Not Track
The Site uses cookies and similar technologies, set by us and by our providers (including Squarespace, Google Analytics, Google Tag Manager, and Jotform), to deliver and secure pages, process form submissions, remember your preferences, and measure how the Site is used. You can block or delete cookies through your browser settings; blocking essential cookies may prevent parts of the Site from working. Where required by law, we ask for your consent before setting non-essential cookies, and you can change that choice at any time through the cookie control on the Site.
Do Not Track. Some browsers transmit a “Do Not Track” signal. There is no common industry standard for interpreting it, and the Site does not currently respond to DNT signals. We honor the Global Privacy Control (GPC) signal where applicable law requires it.
6. Marketing email and your choices
We may send you newsletters, marketing, and promotional material. We send commercial email on a permission basis only — see §7 for our full practices.
You may opt out of marketing at any time by clicking the unsubscribe link in any email we send, or by writing to communications@atelier4.com. Requests are honored promptly and at no cost, and we will not charge you or treat you differently for opting out.
Opting out of marketing does not stop transactional messages, including but not limited to quotes, shipment updates, condition reports, and invoices necessary to perform the work we are doing for you.
To review, correct, or update the personal information we hold about you, or to request its deletion, email communications@atelier4.com. See §9.
7. Anti-Spam Policy
Atelier 4 has a zero-tolerance policy toward spam. We prohibit the advertising or promotion of this website, our domain names, our brand, or our services through unsolicited email or any other unsolicited electronic message.
Scope. This policy applies to Atelier 4, our employees, officers, and agents, and equally to our clients, vendors, contractors, subcontractors, agencies, resellers, referral partners, and any other third party. No person or organization is authorized to promote atelier4.com, any Atelier 4 domain, or any Atelier 4 service by means of unsolicited messages, whether or not they are compensated for doing so, and whether or not they act at our request.
Prohibited conduct. The following are prohibited in connection with the promotion of this website or our services:
- Sending unsolicited bulk or commercial email (“spam”) of any kind, in any volume, or unsolicited commercial messages by SMS, instant message, fax, social media direct message, web form, or comparable channel.
- Sending commercial email to anyone who has not given prior, verifiable, affirmative consent, or who has withdrawn it.
- Sending commercial email to addresses obtained by purchase, rental, trade, harvesting, scraping, or any means other than direct opt-in by the recipient.
- Falsifying, forging, obscuring, or misrepresenting header information, sender identity, return-path, reply-to address, originating domain, or routing information, or using deceptive or misleading subject lines.
- Sending commercial email without a clear, functioning, no-cost unsubscribe mechanism and a valid physical postal address, or failing to honor an unsubscribe request promptly and in all cases within ten (10) business days.
- Relaying messages through open relays, open proxies, compromised systems, botnets, or third-party mail systems without authorization.
- Directing, commissioning, contracting, incentivizing, or knowingly benefiting from any of the above, whether performed directly or through an intermediary.
Our own email practices. Atelier 4 sends email on a permission basis only. Recipients are on our lists because they requested contact, subscribed directly, or have an existing business relationship with us. Every commercial message identifies Atelier 4 as the sender, includes our valid physical business address, and includes a one-click unsubscribe link, honored immediately. We do not purchase, rent, sell, trade, or share our mailing lists, and we do not send commercial email to addresses we did not obtain directly. Our practices are designed to comply with the U.S. CAN-SPAM Act of 2003, Canada’s Anti-Spam Legislation (CASL), and other applicable laws governing commercial electronic messages.
Enforcement. Violation of this policy is grounds for immediate termination of the offending party’s relationship with Atelier 4 — including any contract, vendor agreement, referral arrangement, or account — without notice and without refund. We reserve the right to report violations to internet service providers, domain registrars, hosting providers, blocklist operators, and law enforcement or regulatory authorities, and to pursue any other remedy available to us.
Unauthorized use of our name and domain. Atelier 4 does not authorize, and has never authorized, any party to advertise atelier4.com or our services through unsolicited messages. Where our domain, brand, or contact information appears in an unsolicited message, it appears without our knowledge or consent, and may be the result of forgery, spoofing, or misappropriation by a third party. We investigate every report we receive and cooperate fully with blocklist operators, mailbox providers, and abuse desks to have the offending material removed.
Reporting a violation. If you received an unsolicited message advertising atelier4.com or referencing Atelier 4, report it to communications@atelier4.com, with full message headers and the complete message body where possible. We investigate every report and will respond with the outcome. Reports may also be sent to Atelier 4, LLC, Attn: Abuse / Compliance, 1960 Cross Beam Dr, Charlotte, NC 28217, 718-433-3500.
8. Security
Atelier 4 takes your privacy seriously. We maintain administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, alteration, disclosure, and loss — including multi-factor authentication on business accounts, access controls limiting personal information to personnel who need it, encryption of data in transit to and from the Site, written data protection terms with our providers, and data protection guidance provided to staff.
No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If you believe your interaction with us is no longer secure, contact us immediately at communications@atelier4.com.
Breach notification. If a security incident compromises personal information, we will investigate, contain and remediate it, and notify affected individuals and the relevant regulators where and as required by applicable law, including the New York SHIELD Act and the breach-notification statutes of the states where affected individuals reside.
9. Your privacy rights
Everyone. You may ask us to confirm what personal information we hold about you, provide a copy of it, correct it if inaccurate, or delete it. Email communications@atelier4.com and tell us what you would like us to do. We may need to verify your identity before acting. We will respond within 45 days, or within any extension that applicable law permits, in which case we will tell you before the initial period ends. There is no charge, and we will not treat you differently for asking.
California residents. California law may give you the right to know what personal information we collect, to request its deletion or correction, to receive a copy, and to opt out of the sale or sharing of personal information. We do not sell personal information and do not share it for cross-context behavioral advertising, and have not done so in the preceding twelve months, so there is no opt-out to exercise; if that changes, we will update this policy and provide the required mechanism first. Residents of other states with comparable privacy laws have similar rights and may use the same contact address.
Nevada residents may submit a request under Nevada law (NRS 603A) directing us not to sell certain covered information. We do not sell personal information, but you may still submit such a request to communications@atelier4.com, and we will honor it going forward.
EU, UK, and Switzerland. If you are located there, you may have rights to access, correct, delete, restrict, or port your personal information, to object to processing based on our legitimate interests, to object to direct marketing at any time, and to withdraw consent where we rely on it. We process this information on the following legal bases: performance of a contract, to arrange and provide our services; our legitimate interests, including operating and securing the Site, preventing fraud, and business communications; compliance with our legal, customs, tax, and insurance obligations; and, where applicable, your consent, such as for non-essential cookies or marketing. Note that information you provide will be transferred to and processed in the United States. To exercise these rights, email communications@atelier4.com. You may also lodge a complaint with your local data protection supervisory authority, though we would appreciate the chance to address your concern first.
Appeals. If we decline to act on a privacy request under this Section 9, we will explain why. Where applicable law provides a right to appeal that decision, you may do so by replying to our response or emailing communications@atelier4.com with “Appeal” in the subject line. We will respond to appeals within 45 days (or the period applicable law requires) and, if we uphold our original decision, will explain how to submit a complaint to your state attorney general or other applicable regulator.
10. Changes and contact
We may update this policy from time to time to reflect changes in our practices or in the law. The “Last updated” date above shows when it was most recently revised. If we make a material change, we will post a prominent notice on the Site before or when the change takes effect and, where required by law, notify you directly. We encourage you to review this page periodically.
